ABSTRACT
"The right to education." according to the United Nations Committee on Economic, Social, and Cultural Rights, is not only a fundamental human entitlement but also a crucial means of realizing other human rights. The UN has incorporated this right into its various documents to strive towards universal education. Additionally, many regional and national frameworks have also enshrined this right within their jurisdictions. Special provisions for education are extended to minority communities by both the UN and nearly all countries, including India. However, despite the global and national commitments to make education accessible to everyone, the practical implementation of these provisions for minority education falls short. This paper seeks to illuminate the provisions concerning minority education within international and national documents, addressing the obstacles hindering minorities from fully enjoying these rights. It delves into a comprehensive examination of minority education provisions in India, covering both constitutional and statutory aspects. Furthermore, it discusses the failure of governing bodies to rectify implementation flaws, which obstruct the realization of the constitutional goal of equal opportunity, while also proposing potential solutions.
