ABSTRACT

The patenting of inventions in the field of biotechnology has become increasingly important due to the rapid advancements in this field. Bio patenting has been a subject of great controversy because of its potential to restrict access to knowledge and technology that can be used to develop life- saving medicines and therapies. the patenting of living organisms and biological materials has been a contentious issue in the biotechnology industry for several decades. While patents have been a crucial tool for incentivizing research and development, they have also raised ethical concerns regarding the commodification of life and the potential for exploitation. Biotechnology is an interdisciplinary field that has emerged as a key driver of economic growth and development worldwide. In India, biotechnology has gained significant momentum in recent years, driven by a supportive policy environment, the availability of a large pool of skilled scientific manpower, and the presence of a robust research and development infrastructure. This research paper examines the key issues and challenges related to bio patenting. It discusses the various legal and ethical issues that arise in the context of bio patenting and analyses the impact of bio patenting on innovation and access to healthcare. The paper also reviews the current state of the biotechnology industry in India, the major players in the industry, and the role of government regulation in promoting both innovation and access.
