The Evolution Of Transgender Rights In India: A Critical Analysis

ABSTRACT

The transgender community in India was an ignored segment of society and faced deep and pervasive discrimination, despite protection under various provisions of the Constitution. The passage of the Transgenders Persons (Protection of Rights) Bill on November 26th, 2019, which deals with enforcing transgender rights, bought a ray of hope for the Indian Transgender community. The genesis of this acceptance can be traced back to the recognition of each person's equal value and the right to choose, which is an inseparable part of human rights. However, all across India, this community still faces a lot of difficulties. From being discriminated against to being looked down upon, they are always treated as being someone less than an ordinary human being. The authors, through this research paper, try to analyse the Transgender Bill, the rights of the transgender community in contemporary India, along with standing in ancient times. For this purpose, the authors have referred to various textbooks, articles, legislation, and online materials and conducted surveys through a questionnaire. They aim to help the readers understand how the present rights of this community evolved over a period of time in India. In the end, the authors hope that the readers will get to know about the prerogatives of the transgender community and their role in modern India.
