The Mediation Bill: An Inspiration Gone Wrong

The intention of the Legislators is quite manifest in the bill by the adequate and express Long Title which is to promote and facilitate the Mediation Process, to focus upon “Institutional” mediation for resolution of disputes – Commercial or Otherwise (at the same time, a broad category provided for matter which fall in the exemption List). It also seeks to halfheartedly enforce “Mediation Settled Agreements” (though lacks to enforce Mediation in foreign seat). The Highlight of the Bill is to create a Nodal Body, to encourage community mediation, make provisions for Online Mediation Process that too with an effective and reachable mechanism (though it confines itself to mere a sole section) and to deal with matters incidental there to arising out of the bill. In net, as they say “To emerge India as an Hub of Alternate Dispute Resolution”.
