Three Strikes Law: Critical Analysis

Introduction

Any country's criminal justice system is the foundation for establishing peace and tranquility. It is seen as a formal social organization created to respond to deviance classified as a crime. In India, crime control is a perpetual worry, and the system of legal jurisprudence is built on a concept that it is better to let many people go free than to punish even one innocent person. The legislative, the police, the prosecution, the court, and the penal system are all aspects of India's criminal justice system. These components act independently or in concert to achieve a specific goal. The primary goal of the aforementioned components is to provide justice, expedite the trial, and punish the offender or criminal. Often, criminals or offenders get away with their crimes due to a lack of proof, the inapplicability of laws, or the authorities' refusal to hold them accountable. The failure of India's criminal justice system is attributed to a lack of accountability and law enforcement and an overworked court system, and a shoddy jail system.5 As a result, criminals are more likely to commit crimes in the future.
