Uniform Civil Code: An Overview

ABSTRACT

This paper talks about the concept and relevance of Article 44 which is uniform civil code. This paper tries to answer the simple question that whether uniform civil code is suitable for country like India or not. The paper commences with introduction in which is consist of why India is different from other country in the world. Then the concept and the origin of Uniform Civil Code has been explained. The most important point, reasons why the Uniform Civil Code should implement like how it will contribute in the women empowerment and upliftment in the status of women in the society. As we further proceed, this paper put down different cases where judiciary asks for implementation of Uniform Civil Code.

Further the paper discusses all the hurdles which are between the implementation of Uniform Civil Code. The relationship of Uniform Civil Code and the Secularism and Article 25 has been mentioned here. Other challenges like how a nation is going to accommodates its own diversity, how government is going to implement Uniform Civil Code in such a diverse country, has been tried to answer. As we move forward, shinning example Goa and other states has been dash off. Lastly this paper winds up with some suggestion and conclusion.

This is a doctrinal study and the researchers has follows secondary data collection. The researchers use books, articles, comments, notes and case laws with the intention of presenting a holistic view.
