Witness Under The Indian Evidence Act

ABSTRACT

The witnesses play an important role in the pursuit of justice based on the pillars of truth and justice. The consistency and truthfulness of the testimony works in favour of the witnesses because it is done under an oath. Therefore, witnesses play an important role in judging justice when the Criminal Procedure trial begins.

Indian Evidence Act 1872 does not define the term witness. “The Black Law Dictionary defines a witness as a person who sees, knows, or guarantees, or witnesses a witness, either directly or under an oath or commitment, either directly or by testimony, verbal, written, or affidavit.”
