Hague Convention: An Analysis

ABSTRACT

This research paper aims towards providing an analysis of the overall findings in relation to the Hague Convention: The "Convention on the Celebration and Recognition of the Validity of Marriages," which was completed at The Hague on March 14, 1978 the purpose is to demonstrate how the convention harmonises the various marriage laws.

Introduction

Transnational human migration is on the rise in this era of globalisation and liberalisation. Matrimonial conflicts are significantly growing as a result of the growth in international weddings and divorces. New issues with the celebration of foreign weddings have emerged as a result of advancements in communication and technology, particularly the internet. These changes have led to circumstances where a husband and wife live in separate nations, have their domicile in a third nation, and have children who live in a fourth nation.

Indians have recently immigrated in large numbers to the West, where they are flourishing in nations including the United States, Canada, Australia, the Federal Republic of Germany, France, and the United Kingdom. A sizeable Indian population is drawn to the allure of settling in foreign countries, yet the issues brought on by this movement are still mostly unaddressed.
