Justice In The Age Of Transmission: Ethical Considerations For AI-Generated Evidence

ABSTRACT


The application of Artificial Intelligence (AI) has been rapidly increasing in recent times, and this has led to a swift transformation in most of the arenas including the legal system. The increasing reliance on AI for the delivery of justice especially by the use of AI for evidence generation has led to the transformation of traditional practices of justice and legal processes. Significant ethical questions about accountability, transparency, fairness, and the potential biases, and the ways to mitigate them have been upstretched by the use of AI tools from predicting algorithms to AI-generated forensic investigation to legal state of affairs. The idea of evidential integrity has raised a concern about human control and the verification of AI efficiencies. The opacity of AI systems frequently functions as a “Black Box,” making it challenging to comprehend the contextual framework decisions made by the court and the lack of openness that has led to the compromise of fairness of legal proceedings. This paper explores the intersection of justice and AI- generated evidence, by emphasizing the ethical concerns that arise when AI tools are used to gather, examine, and present evidence before the court.


With a focus on how AI-generated evidence impacts the accuracy and reliability of criminal investigations and trials. This paper specifies the legal framework for the proper application of AI in legal situations by highlighting the guidelines specified by the United Nations Educational, Scientific and Cultural Organization (UNESCO) with portentous aspects on the implication of AI on the principles of justice.


Artificial Intelligence (AI) can be used to expedite the resolution of cases by streamlining legal procedures, automating repetitive tasks, and improving decision-making. This includes how crucial it is to combine human judgment with AI technologies to reduce risks and guarantee that justice is upheld. Further, this paper highlights the key ethical considerations of algorithmic bias, the effect of automated decision-making in the courtroom, and the reliability of the data produced by AI.
