Legal Position Of Rohingyas In India: An Analytical Perspective

ABSTRACT


The Rohingya crisis represents one of the most severe cases of state- sponsored persecution in recent history. Forced to flee Myanmar due to systemic violence and denial of citizenship, Rohingya Muslims have sought refuge across South Asia, including India. Despite international condemnation, India’s legal stance on Rohingya refugees remains ambiguous—caught between constitutional human rights guarantees and national security concerns. This article examines the legal status of Rohingyas in India through the lens of domestic laws, international obligations, judicial precedents, and policy challenges. It argues that India’s refusal to recognise Rohingyas as refugees contradicts its constitutional ethos and international human rights commitments. The article concludes with recommendations for a rights-based refugee policy.
