Major Reforms In Criminal Laws Post 2013 With Special Reference To Rape And Sexual Harassment

ABSTRACT


The year 2013 has been a great and historic year in the journey of criminal laws in India. The incidents like the Mathura Rape case and the Nirbhaya Rape case shook the whole country in a way that there was chaos in the society. People were so agitated that if power was given in their hands, the masses might have killed the accused. As a result, the Indian parliament decided to amend its criminal laws in a way that a heinous crime like rape and brutality associated with it could be stopped.

The criminal law amendment act, 2013 is the act passed by the parliament in the light of protests in the country to bring changes in the Indian Penal Code, Criminal Procedure code, 1973, Indian Evidence Act and inserts some offences related to sexual harassment and make the punishment strict. The paper elaborated the need to amend the criminal laws along with what changes have been brought and how are they being implemented.


The paper discusses the lacunas still present in the criminal laws which need to be ratified as soon as possible or else it will deteriorate the system from inside. It also tries to bring the attention of the readers to the current situation after 7-8 years of these amendments and find the solution of problems persisting in the law and society.
