The Evolutionary Journey of Right to Privacy

ABSTRACT


The issue of right to privacy has been a constantly scrutinised topic of concern for over multiple decades. This question of right was first addressed in 1954 in India in MP Sharma vs Satish Chandra1. Ever since the pivotal role of privacy has been discussed and very recently has been made a Fundamental Right under Article 21 by the famously known Adhaar Case. It is imperative to revisit the settled question of privacy as there are concerns being raised with respect to the citizen rights that seem to be in danger due to the two recent controversies namely; Pegasus and the IT (Intermediary Guidelines and Digital Media)Rules 2021. The current article will deal with Right to Privacy in US and mainly focus on the evolution of the right in India with help of landmark judgments. In the end the researcher will analyse the case of KS Puttuswamy and its effect on data surveillance as well as its misuse.
