ABSTRACT


This study explores the importance of burden of proof in a court of law, examining its historical evolution, theoretical foundations, legal frameworks, practical implications, and normative significance. Through a comprehensive analysis of burden of proof standards in civil and criminal proceedings, as well as in different legal systems and contexts, the study highlights its critical role in ensuring fairness, integrity, and accountability in the administration of justice. Drawing on insights from legal theory, jurisprudence, and empirical research, the study provides valuable insights into the complexities and nuances of burden of proof as a fundamental principle of law, essential for protecting individual rights, promoting access to justice, and upholding the rule of law.
