ABSTRACT
The progression of gender justice in India has been both revolutionary and restrained revolutionary in its moral promise, restrained in its institutional realization. The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 (“POSH Act”) represents a landmark codification of the constitutional right to dignity. It translates the abstract guarantee of equality under Articles 14, 15, and 21 of the Constitution into concrete, actionable duties for employers. Yet, more than a decade after its enactment, the law remains suspended between aspiration and actuality.
