Three Tier Redressal Mechanism Under Consumer Protection Act, 2019 - An Analysis

ABSTRACT


The major legislative reforms as seen in the Indian society, aimed at the empowerment of the consumers by providing a slick grievance redressal mechanism. The Consumer Protection Act, 2019 represents the fruitful efforts of the legislature towards the protection of consumers. This paper examines the three-tier structure namely, District Commission, State Commission and National Commission, in details. Emphasizing on the effect of the shift of the philosophy from caveat emptor to caveat venditor. The study first covers a detailed account of the constitution, jurisdiction, appeal, limitation, powers, and procedural nuances of each commission. It then outlines the efficiency of the system by analysing the various legal provisions and its implications through judicial interpretations. Ultimately, the paper culminates the statute’s capabilities uphold consumer rights through timely, transparent, and accountable adjudication, thereby reinforcing consumer trust in the legal framework.
