An Analysis Of Maintenance Under The Muslim Law

INTRODUCTION

What is maintenance? Maintenance is also known as “Nafqah” which means that a man spends on his family. Food, clothing, lodging etc. are essentially included in Nafqah. Maintenance is a periodic amount of money that is given by the husband to the wife for the divorce or the termination of the marriage. The principle of maintenance includes financial support, educational facilities and means of livelihood. This idea of maintenance in Muslim law was introduced because some people weren’t capable to maintain themselves.

In Muslims, after marriage, it is the requirement of the husband to maintain the wife and provide her with all the basic necessities. Maintenance is provided to the members of the family, children but especially it’s especially for the women after their divorce. And the amount that is provided as maintenance depends on the monetary position of the one who is sure to provide maintenance.
