Analyzing Unicorn Of Uniform Law In India: Uniform Civil Code

ABSTRACT

Uniform civil code is India most debated topic of the time and article 44 is one of the most controversial provisions in Indian constituency. The Uniform civil code is considered to be Unicorn law the law which can’t exist. The existence of Uniform civil code in India is a myth since formation of the constitution, adoption of it is constitutional idea and goal.


The Uniform civil code goes against the whole idea of “secularism” of Indian constitution; Law should be clear and constitutional uniformity in a law doesn’t bring any value to it Uniform Civil Code is statue that refers to provide a common law for all religion law related to marriage, inheritance, adoption and divorce across the country. Uniform Civil Code also concern the question that does India needs UCC or not as the people of India already adopted their personal laws and have great faith in their religion any activity which would they think will affect practicing of their religion will receive huge criticism from the masses. That’s why implementation of UCC is still a question and it also raises the question that is there a really a need to implement UCC?


This research also talks about its advantages and what are the problems faced and what can be a solution, so it can be implemented. But for know its existence is still in question and that’s why it’s considered to be a unicorn law.
